1: These are our Terms & Conditions for use of the site which you may access in several ways, including but not limited to the web, PDAs, mobile phones and RSS feeds. These Terms & Conditions apply whenever you access the Site, regardless of how you access the Site.
2: Any cost associated with accessing the Web Site is the Participant’s responsibility and is dependent on the Internet service provider used. A Participant electing to access the Web Site via wireless platforms for the purpose of registering for and/or entering tips may be subject to content service fees imposed by its telecommunications provider.
3: Registration to the Web Site and entry into any competition conducted on the Web Site is free unless stated otherwise.
4: No prizes are being offered as part of any of the competitions. If any prize becomes available for any competition, information about such prize shall be expressly published on the Web Site, including their values, and shall be governed by separate terms and conditions made available on the Web Site.
5: Information on how to enter, scoring and prizes as posted on the web site forms part of these Terms & Conditions of Entry. Participants not complying with these Terms & Conditions of Entry are ineligible and “TT” reserves its absolute right to disqualify any participant from any tipping competition if any entries do not comply with these Terms & Conditions of Entry. Entry into any tipping competition is deemed to constitute acceptance of these Terms & Conditions of Entry.
6: Tipping competitions are open to residents of Australia (and other countries where the law allows residents to enter tipping competitions of this nature). “TT” employees and its agencies associated with this tipping competition are ineligible to enter. Entry into a tipping competition may incur an entry fee depending on the rules applied to the tipping competition by “TT”. An individual may only be eligible for prizes if they registered as a participant once and therefore may only place one set of tips per round of the season. “TT” reserves the right, in its sole discretion, to verify the identity of the participant. If the individual is found to have registered more than once as a participant “TT” reserves the right to refuse to grant prizes.
7: ”TT” reserves the right not to accept registration for any participant if the registration contains anything slanderous or defamatory or is otherwise unsightly in any way, as determined by “TT” in its absolute discretion. The participants participation in a tipping competition can be withdrawn due to unsightly conduct at any time during and after the tipping competition. This includes any registration that “TT” reasonable suspects have been created using a computerised scripting tool.
8: If a match/round is rescheduled/postponed/cancelled “TT” will advise how the competition will be adjusted / changed to adapt to the relevant event.
9: A Participant may make or change a tip in a round at any time prior to each round’s cut off time as published on the web site – typically this is 5 minutes prior to the start of first game of the pending round.
10: In order to determine the results in each round, participants will be ranked by their score, where the highest score has the highest rank. Round rankings will be determined no later than 72 hours after the last match of the particular round has ended.
11: The end of season rankings will be determined by the participant’s total score for all rounds. End of season rankings will be determined no later than 72 hours after the final round of the season has been completed.
12: In the event that an Entry fee/s (if any) is applicable, the Entry Fee will be collected and managed by the Competition Administrator. This could be “TT” or a Third party. “TT” is not liable and does not accept responsibility for entry fees collected by “TT” or any Third party.
13: Prizes (if any) and their values are as set out on the web site by “TT”. It is the responsibility of “TT” or a nominated party to distribute prizes (if any) to the winners.
14: Tipping competitions are self policed by “TT”, a third party and participants. “TT” does not monitor or police private tipping competitions in any way.
15: In the event there is any dispute concerning the conduct or running of the tipping comp, the decision of “TT” or the nominated Third Party is final and no correspondence will be entered into by the site owner.
16: In the event that a prize winning participant is unable to accept their prize for whatever reason, or the prize is unable to be allocated, within three (3) months of the results being determined, “TT” will award that prize to the participant who met the eligibility criteria and would have been deemed the prize winner had the original prize winning participant not participated in the tipping comp.
17: ”TT” reserves the right, at any time, to verify the validity of registrations and web site activity and the eligibility of applicants and participants (including an applicant’s or participant’s identity, age and place of residence) and to disqualify any participant who submits a registration, tip, or any other information on the site that is not in accordance with these Terms and Conditions of Entry or who tampers with the registration or any processes of the web site. Failure by “TT” to enforce any of its rights at any stage does not constitute a waiver of those rights.
18: Except for any liability that cannot be excluded by law, “TT” and its agencies associated with this tipping comp (including their respective officers, employees and agents) are not liable and do not accept responsibility for:
a) a participant’s tips selections that are not received or which are received and subsequently corrupted or rejected by the web site server, whether or not after receipt by “TT”;
b) any lost, delayed, misdirected or corrupt emails messages to or from the web site;
c) the web site not being continuously available for use;
d) any loss or damage whatsoever (including but not limited to direct, indirect or consequential loss) or personal injury suffered or sustained in connection with a participant’s participation in the tipping comp or the taking of a prize or otherwise relating to the conduct of the tipping comp, however caused, including failure of the web site or incorrect or corrupt data supplied by “TT” to a participant;
e) any theft, unauthorised access or third party interference;
f) any variation in the value of any prize; or any tax liability incurred by a participant or prize winner.
19: As a condition of accepting any prize, the winner must sign any legal documentation as and in the form required by “TT” and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
20: Information about participants is used by “TT” to assess and process registration in the tipping comp. If an applicant does not provide the required information, “TT” cannot process the registration. All entries become the property of “TT” and will be entered into a database. Information emanating from the participant’s participation in the tipping comp is used by “TT” and its agencies associated with this tipping comp for the determination of winners and distribution of prizes, if any, awarded to a participant. Participants consent to publishing their name and score in the results section of the web site and as otherwise set out in these Terms and Condition of Entry. “TT” will not be held responsible for any loss of reputation, status or otherwise in connection with a participant’s tipping selections and consequential results. It is a condition of entry that participants consent to these uses and disclosures of their information. Information about participants may also be used by “TT”, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and competition campaigns unless a participant otherwise withdraws their consent to the use of their information in this manner.
21: The personal information supplied by entrants when entering this competition will be used by “TT” in accordance with its privacy policy. Please refer to the Privacy Policy by visiting https://tiptopia.com.au/privacy-policy-2/ as entry in this competition is an agreement to be bound by that policy. All entrants may have their details removed from “TT”’s database by contacting “TT”. If details are removed prior to the conclusion of the competition and/or award of prize(s), entrants will forfeit their right to claim any prizes or refund of entry fee if any.
22: Notwithstanding “TT”’s rights to not accept or to subsequently disqualify a participant, “TT” will not be liable for any legal action arising out of any participant’s name or postings on the web site being slanderous, defamatory or unsightly to the public at large, except for any liability that cannot be excluded by law. By participating in the tipping comp, the participant agrees to indemnify “TT”, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto.
23: ”TT” shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law. The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the tipping competition repeatedly is prohibited and all participants or entries submitted reasonable suspected of originating from a participant engaging in such practices will be terminated at the discretion of “TT”.
24: By entering a tipping competition all entrants:
a) assign to “TT” all rights including present and future copyright in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;
b) agree not to assert any moral rights in respect of their entry and the publicity materials (wherever and whenever such rights are recognised) against “TT”, its assigns licensees and successors in title;
c) undertake to “TT” that their entry is not in breach of any third party intellectual property rights.
25: A failure by “TT” to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any other person or participant.
26: ”TT” reserves the right to update terms and conditions from time to time. Changes will be posted on the website.
27: The use of any automated entry software or any other mechanical or electronic means that permits any person to enter any Competition repeatedly is prohibited and all Participants or entries reasonably suspected of originating from a Participant engaging in such practices will be terminated at the Promoter’s sole discretion.
28: Entry into any competition is available during the relevant season provided there is one game within the competition that has not commenced.
29: “TT” reserves the right to remove any message/s that is defamatory or otherwise offensive or inappropriate, as determined by “TT” in its sole discretion.
30: You are not permitted to use any of the logos, trade-marks or information displayed on the Websites without the prior written consent of “TT” or the third party that owns the intellectual property.
31: To enter any tipping competition, a Participant must follow the rules of the competition:
For Ups & Downs Sports Tipping (one team per round) the following Rules apply;
Team Selection:
- You are required to select one team every round of the competition.
- You must select a different team every round until every team has been selected once.
- Once every team has been selected once you can then select a team for a second time (or for a third or fourth time etc if the number of teams and the number rounds in the competition enable this to happen).
Example – If you select the Tigers as your team in round 1, you are unable to select the Tigers again until you have selected every other team once, then you can select the Tigers again.
Point Scoring
- Each round is nominated a Score Multiplier of either 1, 2 or 3 (except the Super Scorer Round – see below). The points your team scores in their game is multiplied by the score multiplier.
- Each Round is nominated as having points either Added (UPS) or Subtracted (DOWNS).
UP Rounds (Points are Added)
- In a Round where the Score Multiplier is x 1 and scores are Added, this is known as a “Standard Round”
- In a “Standard Round” the points your selected team scores is Added to your total score. Example – if your team scores 20 points, 20 points would be Added to your total score.
- In a Round where the Score Multiplier is x 2 and scores are Added, this is known as a “Double Bonus Round”
- In a Round where the Score Multiplier is x 3 and scores are Added, this is known as a “Triple Bonus Round”
- In a Double or Triple Bonus Round the points your selected team scores will be multiplied by the nominated Bonus multiplier and Added to your total score.
- The idea for UP Rounds is to select a team you think will score a large amount of points.
Examples
- In a Double Bonus Round your team’s score will be multiplied by 2 and Added to your total score. Example – if your team scores 20 points, 40 points (20 x 2) would be Added to your total score.
- In a Triple Bonus Round your team’s score will be multiplied by 3 and Added to your total score. Example – if your team scores 20 points, 60 points (20 x 3) would be Added to your total score.
DOWN Rounds (Points are Subtracted)
- In a Round where the Score Multiplier is x 1 and scores are Subtracted, this is known as a “Single Bogey Round”.
- In a Single Bogey Round the points that your selected team scores will be Subtracted from your total score. Example – if your team scores 20 points, 20 points would be Subtracted from your total score.
- In a Round where the Score Multiplier is x 2 and scores are Subtracted, this is known as a “Double Bogey Round”.
- In a Round where the Score Multiplier is x 3 and scores are Subtracted, this is known as a “Triple Bogey Round”
- In a Double or Triple Bogey Round the points your selected team scores will be multiplied by the nominated Bogey multiplier and Subtracted from your total score.
- The idea for DOWN (Bogey) Rounds is to pick a team you think will score a small amount of points.
Examples
- In a Double Bogey round your team’s score will be multiplied by 2 and Subtracted from your total score. Example – if your team scores 20 points, 40 points (20 x 2) would be Subtracted from your total score.
- In a Triple Bogey round your team’s score will be multiplied by 3 and Subtracted from your total score. Example – if your team scores 20 points, 60 points (20 x 3) would be Subtracted from your total score.
Joker Round
- In a “Joker Round” any points your team scores is multiplied x 3 (Tripled) and added to your total score.
- A Joker can only be used once throughout the competition.
- A Joker can only be used in a round when the score multiplier is 1 and scores are added (a “Standard Round”).
Example.
In a Joker Round if your team scores 30 points, the 30 points is multiplied by 3 (tripled) and added to your total score. In this case you would get 90 points added to your total score.
Score Predictor
- In a “Score Predictor Round”, if you correctly predict the points your team scores, your points are multiplied x 3 (Tripled) and added to your total score.
- If you incorrectly predict your teams score in a “Score Predictor Round”, you simply receive the points your team scores.
- A “Score Predictor Round” can only be played when the score multiplier is 1 and scores are added (a “Standard Round”).
- A “Score Predictor Round” cannot be played in the same round you play your Joker.
Examples.
- If you predict your team will score 20 points and they actually score 20 points, the 20 points is multiplied by 3 (tripled) and added to your total score. In this case, 60 points (20 x 3) would be added to your total score.
- If you predict your team will score 40 points and they only score 20 points, 20 points would be added to your total score.
Super Scorer Round
- A “Super Scorer Round” is the ultimate way to score extra points.
- Unlike other rounds where you know beforehand what the score multiplier is for the round, in a “Super Scorer Round”, the score multiplier is determined at the completion of the round and is equal to the number games that you have correctly tipped the winner of in the round.
- A Super Scorer Round can only be played in a round where scores are added.
- Before the round commences, besides picking your team for the round you also have to select who you think will win every game in the round.
Example.
Let’s say the Super Scorer Round has 8 games and you correctly tip the winners of 5 out of the 8 games. What this means is your score multiplier for the Super Scorer Round is 5 and any points your team scores is multiplied by 5 and added to your total score. So if your team scores 30 points, the 30 points is multiplied by 5 and added to your total score. So in this case you would have 150 points added to your total score.
What Happens If You Forget To Put In Your Tip or You Don’t Have a Team You Can Select for the Round.
If you forget to put in a tip or don’t have a team you can select for a round the following happens.
- In a Standard or Bonus Round your team for the round will be the team that is first alphabetically from the teams that you haven’t picked before and you receive Zero points.
- In a Bogey Round your team for the round will be the team that is first alphabetically from the teams that you haven’t picked before. The points this team scores will be multiplied by the nominated Bogey multiplier (x 1, x 2 or x 3) and Subtracted from your total score.
What Happens if 2 or more tipsters are on equal Points at the end of the season.
In the event that 2 or more tipsters are on equal points at the end of the season the winner will be decided on a count back based on the following.
1: The tipster with the highest score in the Super Scorer Round, and if tipsters remain tied,
2: The tipster with the greatest number of correctly predicted scores in Score Predictor round/s, and if tipsters remain tied,
3: The tipster with the highest score in any Score Predictor round/s, and if tipsters remain tied,
4: The tipster with the highest score in a Joker round/s, and if tipsters remain tied,
5: The tipster with the highest score in any Triple Bonus Round, and if tipsters remain tied,
6: The tipster with the highest score in any Double Bonus Round, and if tipsters remain tied,
7: The tipster with the highest score in any Standard Round, and if tipsters remain tied,
8: The tipster with the Lowest score in any Triple Bogey Round, and if tipsters remain tied,
9: The tipster with the Lowest score in any Double Bogey Round, and if tipsters remain tied,
10: The tipster with the Lowest score in any Single Bogey Round, and if tipsters remain tied ,
11: The tipster with the Highest score in Round 1, and if tipsters remain tied,
13: The tipster with the highest score in the lowest round number above Round 1, and if tipsters remain tied,
14: The tipsters will be awarded equal competition winners.
In the event that a dispute arises the decision of the organiser is final.
32: Information about Participants is used by “TT”to assess and process registration in the Competition. If an applicant does not provide the required information, “TT”cannot process the registration. All entries become the property of “TT”and will be entered into a database. Information emanating from the Participant’s participation in the Competition is used by “TT”and its agents for the purpose of determining Competition results. Participants hereby given their consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition. “TT” will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant’s tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information for purposes of the Competitions.
33: All Participants may have their details removed from the “TT” database by contacting the Promoter.
34: Notwithstanding the Promoter’s rights to not accept or to subsequently disqualify a Participant, “TT” will not be liable for any legal action arising out of any Participant’s name or postings on the Web Site being defamatory or unsightly to the public at large, except for any liability that cannot be excluded by law. By participating in the Competition, the Participant agrees to indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto.
35: In the event there is a dispute concerning the conduct or administration of any Competition, the decision of “TT” is final and no correspondence will be entered into.
36: As a member of the Web Site, the Participant agrees to receive a minimum of one email per week from tiptopia.com.au that contains an advertisement from a sponsor of tiptopia.com.au. The Participant can elect to be excluded from said emails however some Web Site features may be made unavailable.
37: “TT” reserves the right to update these Terms and Conditions from time to time. Changes will be posted on the Web Site.
38: “TT” is owned by ASTED Pty Ltd. ACN 40 091 402.
39: Any non-personal communication, comments, ideas or material you post or transmit to “TT” is, and will be treated as, non-confidential and non-proprietary.
40: By transmitting or posting any communication or material to the Websites you grant to “TT” and all of its affiliates, an unrestricted, irrevocable license to use, reproduce, display, modify, transmit, distribute, publish, broadcast or post your communication for any purpose.
41: We have reasonable security measures in place to protect against the loss, misuse and interception by third parties of the information under our control. However, complete confidentiality and security is not yet possible over the Internet. We assume no liability for any damages you may suffer as a result of loss, interception, alteration or misuse of information you provide us or any information transmitted over the Internet. Please see our Privacy Policy for further details.
42: Those who choose to access the Websites from other locations do so on their own initiative and their own risk and are responsible for compliance with local laws.
43: If you have submitted personal information through the Websites and would like that information deleted from our records, please contact us at our e-mail address info@tiptopia.com.au
We will use reasonable efforts to delete this information from our existing files.
